WHAT DATA IS COLLECTED, AND HOW IS IT COLLECTED WHEN YOU VISIT THIS WEBSITE?
We only collect personal data you voluntarily provide us, or data necessary for us to provide our services to you. When you visit our website, our web servers save information on the browser and operating system you use, the website from which you visit us, the websites you visit on our page, and the date of your visit as well as other information as a standard practice. We also save the internet protocol address (IP address) assigned to you by your internet service provider for seven days for security reasons, for instance to detect attacks against our website. With the exception of the IP address, personal data is only saved if you provide it to us. You may provide us with your e-mail address, name, mailing address, telephone number, or any other data to receive information on our products, to take part in sweepstakes our surveys, to purchase products, or simply so you can be kept up to date on interesting products.
When you access our website and enter something into a free text field and, for instance, make a comment, our systems save your internet protocol address (IP address). We need this information for security reasons, to prevent fraud and to prevent other hazards.
VIVIL uses technical and organisational security measures to protect your personal data processed by us against manipulation, loss, destruction, and access by unauthorised persons. Our security measures are continuously improved as part of technological development.
Only authorised employees have access to your personal data. These may be authorised employees of our service providers who process data on behalf of VIVIL or have access to such data. In this case, we have concluded a so-called “contract data processing agreement” with the service provider.
FOR WHICH PURPOSES DO WE USE YOUR PERSONAL DATA?
We use your personal data only to the extent required to technically administer our website, to manage customers, for the protected download area, to answer your inquiries related to customer service, for product inquiries and surveys, and for marketing purposes. We only use your personal data for the purposes for which you provided it to us.
If you have given us your consent to process your personal data, this data is also used for the purposes indicated in the relevant consent, such as to send you products. You can revoke your consent at any time with future effect.
In relation to your individual use, we would like to make our advertising materials, such as your visit to our website, as user-friendly and customised as possible. Automatically generated information and information provided by you helps us to provide information custom-tailored to your needs. This information collected by our VIVIL website includes “technical data” (such as your IP address, operating system, browser, and the date and time at which you visited our website).
TRANSMISSION OF YOUR DATA TO THIRD PARTIES AND OTHER COUNTRIES
We do not provide your personal data to any other companies who want to use it for direct marketing purposes unless you have given us permission to do so. Furthermore, we provide your personal data to the following other entities to a strictly limited extent:
- Our service providers, so that they can support us, for instance in managing our website or sending products. We have contractually obligated these companies to take the same security measures we do with relation to personal data, to maintain the confidentiality of personal data, and to only process personal data in accordance with our express instructions.
- Personal data is only transmitted to government institutions and agencies in accordance with applicable law.
Your personal data could be transmitted to other countries if one of our service providers is headquartered abroad. In such cases, we conclude a “contract data processing agreement” with the service provider to ensure that they maintain the same degree of data privacy and data security as we do in Germany. This is ensured, for instance, by obligating the service provider to only act upon our instructions and to take all technical measures and update such measures as necessary to protect your personal data to the same extent as it is protected here.
If personal data is processed in a country outside of the EU or EEA, we ensure the appropriate level of data privacy by concluding a standard agreement specified by the EU for this purpose, or the EU has concluded a declaration of sufficiency for that country.
PURCHASES THROUGH OUR VIVIL ONLINE SHOP
When you purchase products through our VIVIL online shop, your personal data is only transmitted in an encrypted manner. We use the TLS security system (transport layer security) in conjunction with 128 bit encryption for each data transfer. This technology offers the highest security. Outsiders cannot read encrypted information on your order, your name, or your address.
When you use the PayPal payment service, we transmit your name, delivery address, e-mail address, and shopping cart details to PayPal so PayPal can correctly allocate your order.
When you use the “Sofort” payment service from the company Sofort GmbH, we transmit your name, delivery address, e-mail address, and shopping cart details to “Sofort” so “Sofort” can correctly allocate your order.
If it is necessary to process your personal data to fulfil our legal obligations (e.g. to archive data), we are authorised to do so under Art. 6 para. 1 letter c GDPR. Your personal data is also processed based on declarations of consent actively submitted by you.
In addition, we process your personal data for the purpose of safeguarding our legitimate interests under Art. 6 para. 1 letter f GDPR. Such legitimate interests include, for instance, maintaining the proper function of our IT systems and marketing our own products.
If you purchase products through our VIVIL online shop, we must process your personal data to fulfil the purchasing agreement concluded with you. The online purchase cannot be completed without collecting and processing your data.
We process your personal data based on declarations of consent actively submitted by you, e.g. during the application process.
We collect personal data whenever you contact us (for instance via the contact form or via e-mail). This data is saved and used only for the purpose of answering your inquiry or contacting you and associated technical administration. The legal basis for processing your data is our legitimate interest in answering your inquiry according to Art. 6 para. 1 lit. f GDPR. If you contact us to conclude an agreement, Art. 6 para. 1 lit. b GDPR is a further legal basis for processing. Your data is deleted after we have finished processing your inquiry. This is the case once circumstances indicated that the relevant matter has been fully clarified and once we are no longer subject to any statutory retention periods.

WEB ANALYTICS BY GOOGLE ANALYTICS
This website uses Google Analytics, a web analytics service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses so-called “cookies,” text files saved on your computer that allow us to analyse your use of the website. The information generated on your use of this website by the cookie (including the abbreviated IP address) is typically transmitted to a Google server in the USA and saved there.
This website only uses Google Analytics with the extension “_anonymizeIp()”, which ensures your IP address is anonymised by abbreviation, excluding any association with you personally. This extension means your IP address is abbreviated by Google within member states of the European Union or other contracting states of the Agreement on the European Economic Area before use. Only in exceptional cases is your full IP address transmitted to a Google server in the USA and abbreviated there. In such exceptional cases, processing is carried out in accordance with Art. 6 para. 1 lit. f GDPR based on our legitimate interest in statistically analysing user behaviour for marketing and optimisation purposes.
You can prevent cookies from being saved by changing your browser software settings accordingly; however, we would like to note that if you do so, you may not be able to use all of the functions of this website in full. You can also prevent data generated by the cookie related to your use of the website (incl. your IP address) from being recorded by Google or processed by Google by downloading and installing the browser plug in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de
Google LLC, headquartered in the USA, is certified for the US-European “Privacy Shield” data privacy agreement, which ensures compliance with the level of data privacy applicable in the EU.

Our website uses social plug-ins (“plug-ins”) from the external social network Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA, (Facebook). You can recognise these plug-ins on our website, for example, wherever you see the Facebook logo. An overview of Facebook plug-ins and their appearances is provided here: https://developers.facebook.com/docs/plugins.
When you access a page of our website that includes such a plug-in, your browser makes a direct connection to Facebooks servers. The content of the plugin is transmitted directly to your browser by Facebook and integrated into the page. Due to this integration, Facebook receives the information that your browser has accessed that page of our website, even if you do not have a Facebook profile or are not currently logged in to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and saved there.
If you are logged in to Facebook, the site can associate your visit to our website directly to your Facebook profile. If you interact with the plug-ins, for instance by clicking the “Like” button or adding a comment, this information is also transmitted directly to a Facebook server and saved there. Information is also published on your Facebook profile and displayed to your Facebook friends.
Please see the Facebook Data Privacy Notice for information on the purpose and scope of data collected, processed, and used by Facebook and your rights in this respect, as well as settings you can change to protect your privacy: http://www.facebook.com/policy.php.
If you do not want Facebook to be able to associate data collected through our website directly to your Facebook profile, you must log out of Facebook before visiting our website. You can also prevent the Facebook plug-in from being loaded using browser add-ons, for instance the “Facebook Blocker” http://webgraph.com/resources/facebookblocker/.
HOW LONG DO WE SAVE YOUR DATA?
We save your personal data which you transmit to us via our website in our databases. Data is saved for as long as necessary for the purpose for which you provided it to us, or as long as necessary to fulfil legal regulations (such as statutory retention periods). For example, this means that data is saved until we have answered a question from you or until a sweepstakes is ended. If you have consented to have your personal data saved for marketing purposes, this means your data is saved for as long as we engage in these marketing activities or until you revoke your consent. You can revoke any consent you may have granted to receive advertisements at any time with future effect.
